Source: [https://www.tonkai.chat/privacy](https://www.tonkai.chat/privacy) > How TONK collects, uses, retains, and deletes account, preference, trip, and ChatGPT-imported music data. # TONK Privacy Policy Effective Date: August 23, 2026 **Who we are.** TONK is provided by **Tonk Ventures LLC** ("TONK," "we," "us," "our"). **Contact:** [alexander@tonkai.chat](mailto:alexander@tonkai.chat) • 2901 Wheelock Rd, Charlotte, NC 28211 This Policy explains how we collect, use, disclose, and protect personal information when you use TONK's website, web app, ChatGPT plugin, or another authorized client, and when you communicate with us over any channel, including email, phone, and SMS (the "Service"). ## 1) Information We Collect **Account & Contact.** Your name, email address, and phone number. **Preferences & Trip Context.** Music preferences you provide or approve, favorite artists or venues, preferred neighborhoods, whether you are a Nashville local or visitor, trip dates, party size, avoidances, and alert settings. **Location.** We **do not** collect or use device/location data unless **you explicitly provide** location to TONK in writing or verbally. We do **not** collect background location. **ChatGPT Music Imports (optional).** When you ask ChatGPT to onboard or refresh TONK, or create a ChatGPT Scheduled task to do so, ChatGPT may send us a compact sample containing artist and track names, signal labels such as "top" or "recent," a short music-taste summary, the connected music service, and the time the sample was observed. TONK does **not** receive your Spotify or Apple Music credentials, provider account identifiers, complete listening history, playlists, playback records, or raw connector responses through this integration. **Usage, Analytics & Advertising Measurement.** Basic site/app analytics (e.g., page views, time in app), advertising-attribution and conversion events (such as account registration or onboarding completion), limited technical logs (IP address, timestamps), and high-level communications metadata (e.g., call/SMS/email send status) for measurement, reliability, support, and abuse prevention. **Payments.** Subscriptions are processed by **Stripe**. We receive tokenized identifiers and billing metadata; **we do not receive or store full card numbers**. **Third-party Event Data.** We compile publicly available event/artist/venue information. TONK does **not** claim ownership over factual data. ## 2) How We Use Information - **Provide TONK.** On-demand artist, location, and event recommendations; asynchronous alerts; account administration and support. - **Personalize.** Tailor results and alerts using your approved music samples, preferences, trip context, and any location information you **choose** to provide. - **Product Improvement.** Analyze aggregate usage to improve features, quality, and reliability. - **Communications.** Send service messages, alerts, and support responses by email or SMS, and provide consented AI phone conversations. Phone calls may be recorded, transcribed, and summarized into Tonk context and processed by ElevenLabs, Twilio, and Tonk service providers. For SMS, reply **STOP** to opt out and **HELP** for help. - **Security & Compliance.** Prevent fraud/abuse, debug and monitor the Service, and comply with legal obligations. - **Payments.** Manage subscriptions, billing, and receipts via Stripe. ## 3) Sharing & Disclosure We do **not** sell your personal information. We share it only as described below: **Service Providers / Processors.** We use trusted vendors to operate the Service, for example: - **Stripe** (billing & payments) - **Supabase** (database/authentication), **Railway** (backend hosting), and **Vercel** (website hosting) - **Twilio** (SMS/voice) - **Email provider** (e.g., Gmail/Google Workspace) - **Analytics, observability, and advertising measurement** (e.g., Vercel analytics, OpenAI Ads measurement, platform logs) - **AI services** to process inputs and generate outputs that power features: **OpenAI** (text processing) and **ElevenLabs** (text-to-speech). We instruct these providers not to use TONK data for model training, and our understanding is they do not use submitted data to train their models by default. We use them solely to provide the Service. **ChatGPT & Connected Music Services.** OpenAI operates ChatGPT and its connections to services such as Spotify or Apple Music under the settings, terms, and privacy policies that apply to your accounts with those services. ChatGPT decides what to send based on your request or scheduled task; TONK receives only the compact payload submitted to its tool. **Legal & Safety.** We may disclose information to comply with law, respond to lawful requests, protect rights and safety, and enforce our Terms. **Business Transfers.** If we are involved in a merger, acquisition, or asset sale, your information may transfer as part of that transaction. **No Other Sharing.** We do not share your personal information with other companies for their independent marketing purposes. ## 4) Cookies/SDKs & Analytics We use cookies and similar technologies (or platform SDKs) to: (a) run the site (authentication, security), (b) remember preferences, and (c) measure usage, performance, and conversions from advertising. For example, the OpenAI Ads Measurement Pixel records a privacy-preserving ad-click reference and conversion events; TONK does not send raw email addresses or phone numbers through this pixel. You can control cookies via your browser settings; disabling some cookies may impact functionality. Where required, we will present a consent banner. ## 5) Location Policy We do **not** access device location or collect background location. We only use location details **if you explicitly provide them** (e.g., telling TONK where you are or where you'll be). ## 6) Data Retention - **Account Data.** Retained while your account is active. If you delete your account, we remove account data from active systems, subject to limited backups and records we must keep for security or legal requirements. - **ChatGPT Imports.** Compact music samples, trip context, and preferences are retained with your TONK account while they are needed to personalize the Service, unless you ask us to delete them. Historical samples may remain part of your personalization record until deletion. - **Billing Records.** Retained **7 years** to meet tax, audit, and accounting obligations. - **Operational Logs/Backups.** Retained for limited periods to ensure security and reliability, then deleted or anonymized. ## 7) Security We use reasonable safeguards including **TLS encryption in transit**, **encryption at rest** (via Supabase methods), **row-level security**, access controls, and least-privilege practices. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. ## 8) Your Choices & Rights - **Alert & Contact Methods.** You can add/remove email or phone in the TONK dashboard at any time. Removing a contact method deletes it from our database and stops further communications to that method. - **SMS Opt-Out.** Reply **STOP** to any SMS to opt out (and **HELP** for help). - **Disconnect ChatGPT.** You can revoke TONK's ChatGPT connection in ChatGPT's app or plugin settings and separately disable or delete any Scheduled task. Disconnecting stops future ChatGPT-to-TONK transfers but does not automatically delete information already saved in your TONK account. - **Access / Deletion.** You can request a copy or deletion of your data by emailing [alexander@tonkai.chat](mailto:alexander@tonkai.chat) . You may request deletion of only your ChatGPT-imported music samples and trip context or your entire TONK account. We may take reasonable steps to verify your identity before acting. Deleting TONK data does not delete data held independently by ChatGPT, Spotify, or Apple Music; use their account controls for those services. - **Preferences.** Manage music/alert preferences in your account to control personalization. **California, Other U.S. States, EU/UK (if applicable).** Depending on your location, you may have additional rights (e.g., to know/access, correct, delete, object/restrict processing, data portability, and to opt out of "sale"/"sharing" under CPRA; TONK does not sell personal information). If we process your data in the EEA/UK, our legal bases include **contract** (to provide TONK), **legitimate interests** (security, improvement), **consent** (marketing/SMS, cookies), and **legal obligation** (tax/fraud). You may contact your local authority to lodge a complaint. ## 9) International Transfers If you reside outside the United States and your information is processed in the U.S. or another country, we use appropriate safeguards (such as **Standard Contractual Clauses**) with our processors where required. ## 10) Children TONK is intended for **adults 18+**. We do not knowingly collect personal information from children. If you believe a child provided information, contact us and we will delete it. ## 11) Changes to This Policy We may update this Policy as our practices change. We will update the **Effective Date** above and **email you** for significant changes.
